Lawyers serving Samaná and Las Terrenas
Independent Dominican counsel for foreign buyers, families and investors acquiring or managing real estate across the Samaná Peninsula.
The Samaná Peninsula includes different property settings: condominiums and villas around Las Terrenas, coastal and hillside parcels, established homes, development land and properties held through companies or family arrangements. The landscape is attractive, but location and access can make a precise cadastral and title review especially important. Proxario serves clients in Samaná in person and remotely from our listed Santo Domingo office; we do not claim a separate physical office on the peninsula.
Title due diligence comes before the promise of sale
A seller’s copy of a certificate of title is a starting document, not proof of the current legal position. We request the relevant official certifications, verify the registered owner, compare the cadastral designation across the title, plan and contract, and examine recorded liens or restrictions. We also confirm who has authority to sell and whether civil-status, succession or corporate approvals affect the signature.
The Registro Inmobiliario recommends that a prospective purchaser obtain a certification of the property’s legal status. Its published procedures also distinguish title-registration work from cadastral-survey work. The review must therefore match the asset: an individually titled condominium unit, a parcel in the process of deslinde and a larger development tract do not present the same documentary questions.
Boundaries, access and physical reality must match the record
On the peninsula, the practical value of land may depend on a road, pathway, utility route, slope, watercourse or access to a beach area. A sales visit cannot establish the legal existence or extent of those rights. We compare the site information with the cadastral plan and available registry products, identify whether access is registered or merely used in practice, and flag any matter that calls for a licensed surveyor or technical professional.
Where a parcel has not been properly individualized, the deslinde process may be material. Registro Inmobiliario publishes the current cadastral procedures and requirements, but the status of a particular survey must be verified in its own file. The contract should allocate responsibility, timing and remedies instead of assuming that a pending technical or registry process will finish on a desired closing date.
Foreign buyers can purchase, but the file must be coordinated
A foreign purchaser does not need a Dominican nominee merely because of nationality. The transaction still requires reliable identity and civil-status evidence, source-of-funds documentation when requested, tax and registry steps and a deed capable of registration. If the buyer works from abroad, a limited power of attorney can authorize defined acts. It must follow the notarization, apostille or legalization and Spanish-translation requirements that apply to the country of execution and intended use.
We also examine whether personal ownership, a Dominican SRL or an existing foreign entity fits the investment. A family home may call for a different approach from several rental properties with partners and staff. Company ownership can provide governance and continuity, but also creates corporate books, filings and tax administration. Succession planning should be considered before title is registered, particularly where the buyer has a foreign will, heirs in more than one country or co-owners with different plans.
Las Terrenas rentals and condominium rules
Rental demand does not override the registered condominium declaration and regulations. For an apartment or villa in a condominium, we review the designated use, leasing provisions, shared-area rules, assessments and any documents governing management. Dominican Law 5038 recognizes a unit owner’s ability to lease while requiring conformity with the building’s stated purpose and protections for safety and neighbors. A listing on a booking platform is not evidence that every legal and contractual condition has been met.
For an active rental business, we can coordinate the ownership review with RNC registration, company formation if appropriate, operator agreements, employment or contractor documents, guest terms and a compliance calendar. If the project is promoted as tourism-incentivized, the CONFOTUR classification and resolution are checked separately against the actual phase and unit.
Purchase and closing support
- Initial file review. We read the reservation or draft, seller materials, title copy and plan before defining the searches needed.
- Official checks. We obtain or review current registry and cadastral evidence and verify the parties’ authority.
- Risk report. Findings are separated into acceptable conditions, documents to obtain, contract protections and issues that must be resolved before closing.
- Contract and execution. We revise the promise or purchase instrument, coordinate corporate and remote-execution documents, and organize the closing file.
- Registration follow-through. The agreed title-transfer submission is tracked, and the client receives the resulting official evidence when issued.
Send these materials for an initial assessment

- Company documents, power of attorney or succession records relevant to either party.
- Buyer identification, civil status, address, proposed ownership and intended use.
- Any representation about access, construction permits, rental rights or CONFOTUR status.
