TSS registration: what a Dominican employer must do before the first payroll

Set up the employer, workers and responsible representative across TSS, labour and payroll workstreams before inconsistent records become a compliance problem.

Key takeaways

  • An employer should complete its TSS setup before the first payroll under Law 87-01.
  • The system covers health insurance, pensions and occupational risk.
  • The employer reports payroll and remits the amounts generated under the official parameters.
  • TSS and the Ministry of Labour are separate registrations; neither replaces the other.
  • A contractor label does not control when the facts show an employment relationship.

A new Dominican company is not ready to hire the moment its RNC issues. Between incorporation and a lawful first payroll sits the Tesorería de la Seguridad Social (TSS), the treasury that administers the collection and information system within the Dominican social-security framework created by Law 87-01.

What the system covers

Dominican social security is not a single benefit but three linked regimes, and an employee is enrolled in all of them:

  • Family health insurance (SFS), which gives the employee and dependants access to health cover through an approved provider.
  • Old-age, disability and survivors’ pensions, funded into an individual account with a pension fund administrator (AFP) chosen by the employee.
  • Occupational risk, covering workplace accidents and occupational illness, funded by the employer.

Contributions are calculated on salary and split between employer and employee, with the employer withholding the employee’s share and remitting the total. As with ITBIS, the withheld portion is not the company’s money at any point.

Registering the company

The employer registration draws on documents your incorporation already produced — Registro Mercantil, RNC, the identity of the legal representative and the company’s address and activity. The TSS publishes the current Registro RNC jurídicos requirements, including its registration form, current mercantile record and representative documentation. Once the employer file is open, each employee is enrolled with the identifiers and payroll data accepted by the system.

For foreign employees this is where two workstreams meet. Immigration status and work authorization must support the actual employment, while TSS onboarding requires the identifiers and evidence accepted for that category. DGM states that RT-3 holders do not receive a personal identity cédula, so do not assume a cédula-dependent onboarding path; confirm TSS treatment for the exact category.

The monthly cycle

Employers file a monthly payroll notice and pay the corresponding contributions. Changes matter as much as the constants: a hire, a departure, a salary adjustment or a change of AFP must be reflected in the period in which it happens, because the system reconciles what you declared against what you paid.

Late or omitted filings accrue surcharges, and unlike some tax positions they are difficult to argue away — the record is arithmetic. Companies that put TSS on the same monthly calendar as their DGII filings rarely have a problem; those that treat it as an HR errand usually do.

Why this shows up in diligence

TSS standing is one of the first things a buyer checks when acquiring a Dominican business, for the reason set out in our guide to M&A due diligence: unpaid contributions are a liability that travels with the company in a share purchase. The same is true of banks assessing a borrower and of public entities awarding contracts, several of which require evidence of good standing before award.

The practical consequence is that TSS compliance is not merely an obligation to employees; it is part of the company’s creditworthiness.

Common mistakes

Three recur with foreign-owned companies. Paying a first employee before the employer registration exists creates an unrecorded relationship that may require historical correction. Treating a contractor as outside the system when the relationship in substance looks like employment creates classification risk on inspection or termination. And abandoning the SUIR profile when operations pause leaves the employer without a documented, authority-confirmed status. The correct reporting or closure route must be checked against the actual workforce and current TSS procedure.

Where it fits

TSS sits inside the wider compliance calendar every Dominican company runs, alongside the monthly DGII filings and the annual corporate obligations described in our guide to keeping a Dominican company in good standing. Setting all three up at incorporation — rather than discovering them one enforcement notice at a time — is what our company formation desk does as standard.

Who this service is for

  • New companies preparing to place their first Dominican employee on payroll.
  • Foreign-owned employers that need a legal representative and payroll team aligned on TSS and labour registration.
  • Operating companies correcting missing employees, salary data, representative access or prior-period inconsistencies.
  • Businesses comparing an employee relationship with a genuine independent-service arrangement.

TSS, SUIR and the Ministry of Labour are different

The SUIR is the TSS platform used to register and report employer and worker information for social-security purposes. Labour registration and employment records handled through the Ministry of Labour serve a separate labour-law function. Proxario maps both workstreams with DGII payroll reporting so that names, identifiers, start dates, salary data and status do not contradict one another.

How Proxario handles the setup

  1. Workforce map. We identify the legal employer, establishments, current and planned workers, foreign nationals and proposed contractors.
  2. Classification review. We compare the written contract with the actual control, schedule, integration, tools and economic arrangement. A contractor invoice does not cure employee facts.
  3. Employer file. We prepare the current TSS registration package and representative authority, then coordinate SUIR access.
  4. Worker onboarding. We organise accepted identifiers, start date, salary and other payroll inputs with the payroll professional, and map the separate labour registration.
  5. Compliance handover. We deliver responsibility and evidence checklists for hires, changes, departures, payroll closing and official-status requests. Agency timing is not guaranteed.

Documents the client provides

  • Current Registro Mercantil, RNC record, bylaws or constitutive documents and appointment of the legal representative.
  • Identification and contact data for the company representative and the person who will manage SUIR updates.
  • Employee identification, start date, position, salary components and applicable immigration evidence.
  • Employment contracts, contractor agreements, payroll files and prior TSS, DGII or Ministry of Labour records.
  • Evidence explaining any past period with operations but no reported workforce, or a genuine pause in operations.

Illustrative example: correcting a first remote hire

Example: a foreign-owned SRL begins paying a Santo Domingo coordinator as a monthly “contractor,” but the company sets the schedule, directs daily work and integrates the person into its business. Before adding more staff, Proxario reviews the facts, prepares the employer-registration authority, coordinates worker onboarding and maps the labour and tax records that must align. The scenario is illustrative: classification and corrective steps depend on the actual evidence.

Frequently asked questions

Should TSS registration be completed before the first payroll?

Yes. The employer and employee records should be set up before payroll begins. A late setup may require historical correction and can create social-security, labour and payroll inconsistencies.

Who remits social-security contributions?

The employer reports payroll, withholds the employee portion where applicable and remits the amounts through the system. The current calculation must be taken from the official TSS/SUIR parameters for the payroll period.

How are foreign workers enrolled?

They must be handled under the identifiers and evidence accepted for their actual status. TSS publishes routes for workers who do not yet hold a Dominican identity card; immigration and labour compliance remain separate.

Is calling someone an independent contractor enough to keep them outside payroll?

No. Classification follows the real relationship, including control, integration, schedule, economic dependence and how the work is performed. The contract label does not override the facts.

What should an employer do when operations pause or the workforce reaches zero?

Do not abandon the SUIR profile. Confirm the current reporting or employer-status route with TSS, document the employee departures and use the formal change, suspension or closure procedure that matches the facts.
